The Society of Family Planning is relieved by the Supreme Court (SCOTUS) decision in United States Food and Drug Administration (FDA) v Alliance for Hippocratic Medicine (AHM). In a unanimous decision, the Court held that AHM, the plaintiffs, did not have standing. This means that the case will be sent back to the lower court to decide whether to dismiss the claims brought by AHM. However, earlier this year, the lower court granted a request from a group of states hostile to abortion to intervene in the case. The district court must now determine next steps as it relates to these states. It is possible that the case will continue.
As a Society made up of nearly 1,700 clinicians, scholars, and partners, we know that science matters. Especially the decades of strong science demonstrating the safety and efficacy of mifepristone. We are proud to have contributed to the evidence base and legal arguments that resulted in a just decision. We have created a landing page reviewing key mifepristone science and Society resources. We recognize this is one win in a relentless onslaught of unscientific and unjust attacks on critical health care. We renew our effort to ensure that every person is able to access abortion when they need one. We are committed to continue to fight together for our collective vision of just and equitable abortion and contraception informed by science.
